Babolat Propulse 2 White US Mens sz 9 Tennis Shoes

I bought a NEW-pair & used it for the 1st time in Oct-16 for approx. 1.5 hr on a tennis court. The rubber sole came lose near the toes area, on BOTH shoes: likely due to BAD-glue. These shoes are not fit for its purposes.

I approached [Redacted due to mentioning name] @ Babolat Australia with photos & details. The verbal excuse was that the glue deteriorated due to age: 5 years old ? For all those who have an old pair of BRANDED tennis shoes: have a look to see if the sole separated from your shoes ?

This company wants me to pay the price difference between a new pair & their 'clearance price': ie $55.

I asked for a,
1. refund: base on their ‘clearance price’, plus
2. reimbursement of return freight $14 & noted ‘ACCC suggested that Babolat-AU should bear this cost’.

This company refused my requests & it now wants me to make a claim directly from the retailer, whom I bought the shoes. In my opinion, this company wants to hand-ball the problem & frustrate the process.

In the interest of good reputation: if you sell a product that is ‘not fit for its purpose’, would you supply a replacement free of charge or give refund ?
